ADOPTION

 
  • First visit TLC (St. Theresa's Tender Loving Care Home in Erragadda/Sanath Nagar) and select a girl.
  • Visit State Home. Apply and mention to them that the kid is selected already.
  • State Home Officials will visit the prospective parents' home.
  • Once they are satisfied, they will ask the parents' to take the selected kid to home for one to three days
  • If the parents and the kid gel well and express their concern to adopt the kid, the procedure will follow.
  • The officials will guide through the legal process and finally handover the kid to the parentsThe parents should keep updating the progress of the child for three years or so. Similarly the officials also would follow up.

Govt bid to speed up child adoptions
 
 
New Delhi, June 7: The government is trying to simplify the process of adopting children so that it can be wrapped up in two to three months, officials said.
Adoptions now often take more than a year to complete, the red tape and delays scaring off many couples.
 
A committee formed by the women and child development ministry is drafting amendments to the Juvenile Justice (Care and Protection) Act to streamline adoption procedures, introduce time-bound approvals and mandate specialised centres in every district for adoption by foreign couples.
 
Sources said the ministry did not want children to stay longer than necessary at adoption centres. They added that the Central Adoption Resource Authority was concerned that procedural hassles had led to a 50 per cent dip in the adoption of Indian children by foreigners over the past five years.
 
According to government estimates, there were about 32,000 children in orphanages in the country in 2010 but only 6,286 were adopted, some 600 of them by foreigners. About 25,000 children await adoption every year, the sources said.
 
Under the draft proposals, the district juvenile justice board — an arm of the district court — will approve adoptions instead of the district magistrate. Officials say this has been the most time-consuming part of the adoption process till now since the district magistrates have a lot on their plate.
 
The draft bill also proposes that the child welfare committee, a district-level body that alone can declare a child legally free for adoption, will have to do so within a specific timetable — a fortnight for abandoned newborns and two months for the rest.
 
“Every year, thousands of children languish in the orphanages because the system is so stressful that many prospective parents don’t want to go through the hassle,” a ministry official said.
 
“While many other countries have a single-window process, ours is a 12-step procedure. We hope to bring it down to a simple six-step process.”
 
After all the amendments have been worked out, the draft will be sent to the cabinet for approval. It isn’t clear whether the amendment bill can be introduced in Parliament in the monsoon session.
 
The draft bill recommends that anyone buying or selling children for adoption should be jailed for up to five years and that any irregularities by adoption centres should be punished with a Rs 10,000 fine and a three-year term.

About Adoption

CARA is the only recognized body of the Government in JJ Act (apart from the state governments) that can frame guidelines for adoption.  Please quote the following section and central rule to the lawyer.

Section 41 (3) Adoption: In keeping with the provisions of the various guidelines for adoption issued from time to time, by the State Government, or the Central Adoption Resource Agency and notified by the Central Government, children may be given in adoption by a court after satisfying itself regarding the investigations having been carried out as are required for giving such children in adoption.

Rule 33 (2) Adoption: For all matters relating to adoption , the guidelines issued by the Central Adoption Resource Agency and notified by The Central Government under sub section (3) of section 41 of the Act (referring to the above section), shall apply.

What I see in the above section and the rule is that anything that is framed by CARA and notified by the central governmentis the law of the land.

About single parents adopting, law says this:

Section 41 (6):

The Court may allow a child to be given in adoption

(a) to a person irrespective of marital status or
(b) to parents to adopt a child of same sex irrespective of the number of living biological sons or daughters or
(c) to childless couples.

Now having said this, states are required to frame their own rules to be in compliance with the JJ Act.  Some states are restricting single fathers from adopting a girl child.  If the rules of the states are out of bounds of the JJ Act, they are open for a legal challenge in the court of law.

About Adoptions in AP
 
I have a very good news to share with you all. Today I met Ms. Padmavathi who is the Child Welfare Committee member of Rangareddy Dt. She also acts as a Trustee of KGNM (Kasturba Gandhi National Memorial) Trust, Hydershakote, Bandlaguda, Hyd.
 
I shared about PGCAI with her. She mentioned that now Adoption Policies have become friendly and authority has been given to District Officials as well to give children for adoption.
 
As per her, this is the process:
 
1. The interested parents should submit an application at Sisu Vihar.
Now 2011 applications are being considered in AP. Till then all requests are addressed)
2. The officials will conduct home study. 
3. Once this is completed, they invite the parents to the Home and show them the children who match their features.
4. Once the parents select a child, they will send the child with the parents for a 3-day stay. 
5. If everything is ok and the child gets along well with the parents and parents are happy with the child, then the final process of signing the documents would start.
6. The clause that the parents should inform the children that they are not biological but adopted is only for a caution but not mandatory and she mentioned that in Indian scenario, it is not possible as most of the parents might not agree for this clause.
 
Coming to single parents (unmarried youth) adopting children, as per rule, they will consider giving children of age above 10 years for Foster Care.

She also mentioned that once we apply in Sishu Vihar and can give a copy to her, she will try to speed up the process.

Please know the places and people who train differently abled to manufacture products.

Shraddha - Life Beyond Imagination, is a home for the differently abled run by Sujatha Burla, who herself is disabled heart-down. She does sofa covers for a living and is willing to teach and accommodate more disabled people with herself. She's been doing this for quite some time now and it is a set industry

When we visited the Abilities Mela 2009,met few organizations and took contacts with idea of giving more opportunities to them as and when possible.
So,If still that stall offer is open, these organizations can be approached.

1)Sai krishna teja institute.
Differently abled persons housed in this are involved in making various items.They had a stall in Abilities mela 2009.

2)Another organization for disabled women is ISNI.
They also had a stall-clothing and hand made cards,


3)Shri guru sankalpam : Speciality is parents of the differently abled children/persons are also involved in making items.
I remember they had jute bags which is need of hour now.
